This Terms of Use Agreement (this “Agreement”) is a legal agreement between you (“you” or “your”) and Onemedia Network Limited, a company having its registered office at F-45, Block F, Green Park, New Delhi – 110016, its affiliates, and each of their respective successors and assigns (collectively, the “Company”) governing your use of (i) any seminar, workshop, classname, conference, course or other service (collectively, the “Services”), offered or promoted by the Company through its mobile application “PMC” (hereinafter referred to as the “Application”); and (ii) any materials, content or other offline components provided by the Company through the Application (the “Materials”).

By accessing the Application or participating in any session or using any of the company’s services, you are agreeing that you have read, and agree to comply with and be bound by, the terms of this agreement in their entirety without limitation or qualification and all applicable laws and regulations. If you do not agree to be bound by the terms and conditions of this agreement, do not access the Application, participate in any classname, or use any services, offered by the company.

1. Minimum Age Requirement

The services are intended for those who are 18 years of age and older. If you are under the age of 18, you may not use the services without providing verifiable consent from a parent or legal guardian...

2. Authorization and Release to Use Your Personal Information

If you participate in a seminar/workshop/classname/session or otherwise use the Company’s Services, you hereby grant the company the irrevocable and perpetual right to record, edit, publish, and distribute your Personal Information...

3. Prohibition on Recording

Except as otherwise permitted in writing by the Company, no materials or information, regardless of form, may be recorded, copied, reproduced, republished, or distributed without prior consent.

4. License Grant

The Company grants you a limited, non-exclusive, non-transferable license to access the Application and download the Materials solely for your own use...

5. Restrictions on License Grant

• You shall not license, sell, or distribute the Application or the Materials...
• You shall not copy, modify, or create derivative works from the Application...
• You shall not access the Application to build a competitive product...

6. Privacy

Information collected by the Company is subject to the Privacy Policy available here.

7. User Content

You represent and warrant that any material you post does not infringe on any third-party rights...

8. Intellectual Property Ownership

All rights in the Application, Materials, and non-user content belong exclusively to the Company or its licensors...

9. Trademarks

The PMC Hindi logo and related marks are trademarks of Onemedia Network Limited and may not be used without prior written permission.

11. Term; Termination; Suspension of Access

This Agreement begins upon your first use of the Application and may be terminated by the Company for breach...

12. Medical Disclaimer

The services are not a substitute for professional medical advice. Please consult your physician before participating.

13. Disclaimer of Warranties

The Application is provided "as i" without warranties of any kind...

14. Limitation of Liability

In no event shall the Company be liable for indirect, incidental, or consequential damages exceeding $100.

15. Release

You agree to release and indemnify the Company from any liability relating to your use of the services or posting of content.

16. Account Access

You are responsible for safeguarding your login credentials and all activities under your account.

17. Modification to Terms

The Company may revise these Terms from time to time. Continued use of the Application implies acceptance.

18. Dispute Resolution

This Agreement is governed by Indian law. Disputes shall be resolved in New Delhi courts after amicable negotiations.
